La sociedad del conocimiento y la introducción en los procesos de enseñanza-aprendizaje de las tecnologías de la información y la comunicación, están exigiendo de quienes nos dedicamos a la educación en el ámbito universitario, la utilización de nuevas estrategias didácticas y la reinvención de algunas antiguas o no tan nuevas. Se trata de dar respuesta a la demanda social de “aprender de otra manera” para mejorar la inserción de los nuevos egresados en su ámbito profesional. Esta nueva forma de aprender (...) debe tener en consideración las exigencias de los nuevos contextos de enseñanza-aprendizaje, donde el protagonismo de los estudiantes es un elemento esencial y la relación de lo aprendido con sus posibilidades de aplicación en el contexto profesional es el otro. Casualmente el modelo de formación basado en competencias desde el enfoque socioformativo coincide en ambos protagonismos y el portafolio como estrategia didáctica que puede utilizarse en este modelo puede ayudar a dotar de protagonismo al que aprende haciéndole tomar conciencia de que el aprendizaje no se produce de manera automática sino a través de una serie de pasos y etapas que a la vez que se van consiguiendo nos permiten reflexionar el proceso. Una vez llevado a cabo este proceso de reflexión general, puede aplicarse en el ámbito médico para iniciar al estudiante a tomar conciencia de su semejanza con el diagnóstico clínico. Primeramente, haremos un repaso por la noción de diálogo, relación o encuentro en las artes y el pensamiento que se desarrollan durante los años sesenta del pasado siglo y fuertemente a partir del episodio de revueltas del 68. Sostenemos que en las artes, lo dialógico representó una estrategia política por partida doble: la conversación y el encuentro eran tanto un vector de ruptura con los modos de apreciar y vivir lo sensible y de entender el hecho artístico, como un procedimiento (...) para someter el individualismo y construir una presencia corporal y común considerada perdida y/o necesaria. Seguidamente veremos en qué sentido el diálogo se presenta como una de las claves de la filosofía política actual preocupada por combatir al sujeto individualista e hiperproductivo que propugna el neoliberalismo. Finalmente, trataremos de llevar a efecto esta invitación a dialogar. Así, la última sección de este escrito tomará la forma de una conversación entre nosotros, para interrogarnos juntos sobre algunas de las cuestiones anteriormente esbozadas. (shrink)

El artículo revisa las aportaciones más trascendentes que Jordi Ferrer ha hecho a la tradición racionalista de la prueba jurídica y evalúa críticamente el limitado papel que, desde su óptica, le corresponde desempeñar a la epistemología en la discusión general sobre los estándares de prueba apropiados para las distintas ramas del derecho. Más específicamente, se analiza la irrelevancia que Ferrer parece atribuir a dicha disciplina –o el silencio que debe guardar–, respecto del establecimiento del estándar de prueba deseable en materia (...) penal. Se concede que, en efecto, le corresponde al pueblo tomar la decisión de qué estándar implementar. No obstante, se sostiene, ello no impide que la epistemología incida en el proceso de formación de dicha decisión mediante la realización de observaciones, el ofrecimiento de argumentos y la propuesta de metodologías adecuadas, con miras a que aquella se tome en un contexto mejor informado y sea lo más racional posible. Se ilustra esta posición haciendo referencia al proyecto de epistemología jurídica de Larry Laudan. (shrink)

El objetivo del trabajo consiste en revisar dos versiones del argumento que concibe a la averiguación de la verdad como un factor que confi ere legitimidad al ejercicio de la función jurisdiccional penal: la de Ferrajoli y la de Laudan. Se sostiene que su estudio minucioso puede proporcionar bases racionales para decidir sobre la conveniencia de suscribir un garantismo extremo o uno de carácter más mesurado. Innovation and sustainability are postulated as key variables for the future of large commercial distribution. In addition, the development of Information and Communication Technologies solutions, and especially those related to Artificial Intelligence and digitization, are particularly relevant factors in the current pandemic scenario in which retail companies operate. These tools are essential to face the derived changes in commercial relations, especially between companies and consumers. For all these reasons, this work aims to examine the effect of ICT, as a driving (...) factor for innovation and its direct and indirect impact on sustainability in retailing. Furthermore, this study takes into account the eventual differences in these relationships according to the types of store formats. To achieve the aforementioned objective, a theoretical model is proposed that is tested through an empirical study carried out on a sample of 510 consumers of three store formats of grocery retail formats in Spain. For the analysis of the data obtained, the partial least squares regression technique and the Multigroup Analysis were used. The results obtained confirm the direct and indirect effect of ICT on innovation and sustainability in grocery retailing. In addition, the results indicate that consumers unequally perceive the technological progress of companies. These differences are greater between discount stores versus hypermarkets and supermarkets. The larger the size of the store format, the higher the incidence of ICT in relation to innovation. Therefore, it is vital to take ICT into consideration, where Artificial Intelligence is imperative for the growth and development of sustainable competitive advantages in retail companies. (shrink)

El Tercer Sector de Acción Social español es un agente clave para el impulso de la inclusión en el modelo social europeo. Su fortaleza radica en las alianzas internas entre entidades, así como al establecimiento de vínculos con el estado y el mercado. Se mostrará, mediante análisis documental de fuentes secundarias, la tesitura en la que están ambos tipos de gobernanza con respecto a las políticas para la inclusión en la UE. Los resultados muestran una progresión en cuanto a estructuras, (...) canales, ideario y metas comunes, pero también déficits que señalan el camino a recorrer hacia la colaboración y participación. El artículo aborda la pandemia del covid-19 como elemento contingente y su efecto de develamiento respecto de algunas manifestaciones contemporáneas de la ideología neoliberal en Latinoamérica. De esta forma, en base a conceptos filosóficos y psicoanalíticos de orientación lacaniana planteados fundamentalmente por Slavoj Žižek, se examinan los usos críticos de la noción de ideología en sus diversas manifestaciones: miedo al otro, imposición de la lógica del empresario de sí, destrucción de lazos sociales, extractivismo de recursos naturales y fetichización de los (...) discursos de unidad frente a la pandemia. La hipótesis radica en que la pandemia presenta una oportunidad para repensar la subjetividad contemporánea, mediante la confrontación con el Real que bordea a la simbolización y, en definitiva, a la captura ideológica, a fin de poner en cuestión la afirmación de que no hay alternativa. The received view of Martin Heidegger’s work is that he leaves little room for reason in the practice of philosophy or the conduct of life. Citing his much-scorned remark that reason is the “stiff-necked adversary of thought”, critics argue that Heidegger’s philosophy effectively severs the tie between reason and normativity, leaving anyone who adheres to his position without recourse to justifying reasons for their beliefs and actions. Transcending Reason is a collection of essays by leading Heidegger scholars that challenges this (...) view by exploring new ways to understand Heidegger’s approach to the relationship between reason, normativity, and the philosophical methodology that gives us access to these issues. The volume points to Heidegger’s novel approach to reason understood in terms of what he calls Dasein’s ‘transcendence’—the ability to occupy the world as a space of normatively structured meanings in which we navigate our striving to be. The truth of a statement depends on the world in two ways: what the statement says is true if the world is as the statement says it is; on the other hand, what the expressions in the statement mean depends on what the world is like (for instance, on what conventions are in place). Each of these two kinds of dependence of truth on the world corresponds to one of the dimensions on the two-dimensional semantic framework, developed in the 1970’ (...) in the work of Evans, Kaplan, Kripke and Stalnaker. The introduction provides a systematic overview of the framework, the ideas of its earlier originators, recent developments and criticism. Ten countries have established quotas for female representation on publicly traded corporate and/or state-owned enterprise boards of directors, ranging from 33 to 50 %, with various sanctions. Fifteen other countries have introduced non-binding gender quotas in their corporate governance codes enforcing a “comply or explain” principle. Countless other countries’ leaders and policy groups are in the process of debating, developing, and approving legislation around gender quotas in boards. Taken together, gender quota legislation significantly impacts the composition of boards of directors (...) and thus the strategic direction of these publicly traded and state-owned enterprises. This article outlines an integrated model of three institutional factors that explain the establishment of board of directors gender quota legislation based on the premise that the country’s institutional environment co-evolves with gender corporate policies. We argue that these three key institutional factors are female labor market and gendered welfare state provisions, left-leaning political government coalitions, and path-dependent policy initiatives for gender equality, both in the public realm as well as in the corporate domain. We discuss implications of our conceptual model and empirical findings for theory, practice, policy, and future research. These include the adoption and penalty design of board diversity practices into corporate practices, bottom-up approaches from firm to country-level gender board initiatives, hard versus soft regulation, the leading role of Norway and its isomorphic effects, the likelihood of engaging in decoupling, the role of business leaders, and the transnational and international reaction to board diversity initiatives. The commentaries on the Ethica nova and the Ethica vetus written by some masters of the arts – presumably operating in the Paris faculty – in the first half of the thirteenth century expound in an original way the doctrine of the virtutes consuetudinales which Aristotle, at the end of the first book of his Ethica (I 13), distinguishes into the two main classes of the “moral virtues” and the “intellectual virtues”. The present paper aims at highlighting the particularly important (...) task which is assigned to the intellectual virtues in these early commentaries: joining man to God directly, through a contemplation which becomes love. The masters of the arts maintain that the moral virtues, in spite of the definition given by Aristotle (habitus a quo quis bonus est et opus eius bene reddit), are not sufficient alone to bring man to perfection, but that other more perfect virtues, namely the intellectual ones, are needed in order to make him know and love the supreme good. Having no knowledge of the sixth book of the Ethica, in which Aristotle deals in particular with the intellectual virtues, our masters know only their general description and are concerned with clarifying their relationships with the moral virtues, compared to which they appear to be sometimes really distinct and sometimes united to them in sharing the recta ratio, so much that they may constitute a double virtue. Although the masters of the arts seem to be well-informed about the teaching of the theologians – which they often cite without opposing to it, albeit stressing their own philosophical point of view –, it is significant that no reference whatsoever is made by them to the theological virtues and that they have recourse to the themes of Avicennian mysticism such as the doctrine of the two faces of the soul. Besides presenting the commentaries on the Ethica vetus from a general point of view, I will focus on the Paris commentary in Ethicam veterem (Paris BN lat. 3804A, ff. 152ra-159vb, 241ra-247vb; Paris BN lat. 3572, ff. 226ra-235ra), of which I am preparing a critical edition. The Paris commentary contains in fact a special and original discussion of the doctrine of the virtutes intellectuales. (shrink)

The book outlines the historical development of Public Law and the state from ancient times to the modern day, offering an account of relevant events in parallel with a general historical background, establishing and explaining the relationships between political, religious, and economic events.

This paper aims to produce a defense of the ethical significance of Confucian ritual. An adequate defense must explain how these conventions are based in a culturally-neutral, objective ground. After a brief account of how Confucians view the relationship between rituals and moral goodness, I consider three sorts of justification. Mencian naturalism appeals to a conception of flourishing that is grounded in human nature. Xunzian consequentialism looks to how ritual brings about social order. I argue that both of these approaches (...) fail because they are unable to account for the normative fineness of rituals, which refers to the precision and detail of ritual propriety. Instead, I look to Xunzi for a justification of rituals in terms of their role in beautifying human nature. I argue that this view provides a sort of objective ground for ritual, while also preserving their normative fineness. I conclude with remarks on how Xunzian aestheticism may be useful for understanding other areas of moral life. (shrink)

El artículo se centra en el filósofo argentino Eugenio Pucciarelli (1907-1995) y su recepción de la fenomenología, a la que confiere un sesgo humanista. Se procederá a una introducción a su contribución a la fenomenología en América Latina y se abordarán los siguientes temas: 1) la misión de la filosofía, las diversas vías de acceso a su esencia, en particular aquellas de Scheler, Dilthey y Husserl, 2) su recepción de Husserl en cuanto concierne a los ideales de ciencia y de (...) razón, 3) la crisis de la razón y de la evidencia, 4) su concepción pluralista de la razón, del tiempo y de la cultura, 5) humanismo y libertad. La tesis sostiene que su concepción de la filosofía, que enfatiza la dimensión personal y el compromiso social de la práctica filosófica, revela un profundo humanismo pluralista que no descuida su función militante y crítica, evidenciado así la actualidad de su mensaje. What place, if any, does love have in Kantian ethics? This chapter is divided into three parts. First, I discuss Kant’s own account of moral versus non-moral love as found throughout his various writings and show how this closely parallels his account of moral versus non-moral friendship. Second, I discuss contemporary Kantian accounts of both friendship and love, highlighting how they go beyond, and in some ways seem to significantly improve upon, Kant’s own views via their appeal to Kant’s Formula (...) of Humanity. Lastly, I discuss the overall merits of what I call ‘Kantian moral love’. I argue that while Kantian moral love might rightly identify, from the moral point of view, how we ought to act and think when loving other people, it fails to provide a complete account of love, crucially leaving out certain key elements from the wide range of loving relationships we find ourselves in, especially romantic love. That is, while Kantian moral love might successfully identify a morally ideal way to love other people, it falls short of capturing the full essence of love—mainly because love is not simply a moral affair but also a matter of the heart. Inmersos en un ambiente sociocultural impregnado por la increencia, el creyente se encuentra hoy fuertemente confrontado: convocado para anunciar a Dios a sus contemporáneos, y a un tiempo persistentemente rechazado por ello. De ahí que sea una urgencia reflexionar sobre cuáles son las claves antropológicas del hombre contemporáneo que le han conducido a tal cerrazón en su estructura íntima hasta instalarlo en la increencia. El presente artículo aborda no sólo en el por qué el anuncio cristiano no interesa al hombre (...) contemporáneo, sino, más radicalmente, por qué Dios ha dejado de ser significativo al hombre. Y también algunas consideraciones desde donde proponer la fe hoy, alcanzar nuevos caminos para el anuncio del Evangelio. (shrink)

La presente investigación, recogiendo todo el corpus ratzingeriano, pretende ofrecer una sistematización del tema esperanza, su fundamento bíblico, su estructura antropológica y su composición teológica.
